Terms and conditions of use and sale

Section 1. General Provisions and Definitions

These Terms and Conditions govern your access to and use of the mobile application and web platform operated by Flight-Industry LTD, as well as any booking services offered through the platform. By accessing, browsing, or using the platform, or by placing a booking, you agree to be bound by these terms in their entirety. If you do not agree with any part of these terms, you must refrain from using the platform.

Throughout this document, terms such as "User", "Customer", "You", and "Your" refer to any individual or entity accessing the platform or reserving travel services. Terms such as "Company", "We", "Us", and "Our" refer exclusively to Flight-Industry LTD, a company registered in the United Kingdom under the laws of England and Wales. The term "Supplier" refers to third-party travel service providers, including airlines, air carriers, and accommodation properties. The term "API Partners" refers to technical integrators including Duffel Technology Limited for flight services and LiteAPI for accommodation services.

Section 2. Role of the Company and Intermediary Status

Flight-Industry LTD acts exclusively in the capacity of an intermediary booking agent and technology provider. The platform enables users to search, compare, and reserve travel services provided by third-party suppliers through API integrations.

When you make a booking, the contract for the underlying transport or accommodation service is concluded directly between you and the respective supplier. Flight-Industry LTD is not a carrier, hotelier, tour operator, or provider of combined travel packages.

All travel services available on the platform, including flights and accommodations, are selected and booked as standalone services. Reserving a flight and an accommodation through the platform does not constitute a travel package or a linked travel arrangement within the meaning of the UK Package Travel and Linked Travel Arrangements Regulations 2018 or EU Directive 2015/2302.

Section 3. Pricing, Markups, and Payment Collection

Prices displayed on the platform are determined dynamically using inventory and tariff data supplied by our partners. As an intermediary, Flight-Industry LTD applies a markup, service fee, or margin to the base rates provided by suppliers and API partners.

The total amount displayed at checkout represents the final retail price, including all applicable service fees, markups, and known taxes. Flight-Industry LTD, or its designated payment processor, collects the total booking fee from you at the time of purchase in connection with the fulfillment of your requested reservation.

All payments are processed in the currency specified during checkout. If your payment method is denominated in a different currency, exchange rates and cross-border transaction fees determined by your financial institution may apply.

Section 4. Flight and Accommodation Reservations

Flight bookings placed via the platform are governed by the specific conditions of carriage, fare rules, and operational policies of the operating airline.

Flight-Industry LTD does not hold direct IATA accreditation; flight ticketing, inventory distribution, and issuance are handled through Duffel Technology Limited and its authorized partners. Check-in procedures, baggage allowances, seat assignments, and flight schedule changes remain under the sole control of the airline.

Hotel and accommodation bookings are governed by the individual house rules, cancellation policies, check-in requirements, and regulations of the specific property reserved through LiteAPI.

Local taxes, including city, tourist, or resort fees, may not be included in the prepaid total and may be collected directly by the accommodation provider where mandated by local regulations.

A reservation is deemed confirmed only upon the issuance of a written confirmation containing a booking reference code transmitted via the platform or email.

Section 5. Cancellations, Modifications, and Refunds

All requests for modifications, cancellations, or refunds are subject strictly to the fare rules, tariff conditions, and cancellation policies established by the respective supplier.

Service fees, markups, and administrative margins charged by Flight-Industry LTD are non-refundable, except where required by law or in circumstances involving a complete service failure by the supplier.

In addition to any charges imposed by suppliers, Flight-Industry LTD reserves the right to assess a reasonable administrative fee for processing cancellation or modification requests on your behalf.

Section 6. Passports, Visas, and Travel Documentation

It is your sole responsibility to ensure that you and all traveling passengers possess valid travel documentation, including passports, entry visas, transit visas, electronic travel authorizations such as ESTA or eTA, and required health or vaccination certificates.

Flight-Industry LTD accepts no responsibility or liability for any financial loss, delay, extra expense, or denial of boarding or entry caused by invalid, incomplete, or missing travel documentation.

Section 7. Limitation of Liability

The platform is provided on an as-is and as-available basis without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure operation of the platform.

Flight-Industry LTD disclaims all liability for any non-performance, deficiency, delay, cancellation, overbooking, strike, or event of force majeure caused by airlines, hotels, or API partners.

To the fullest extent permitted by applicable law, the total cumulative liability of Flight-Industry LTD for any direct damages arising out of or in connection with the use of the platform shall be capped at the total service fee or markup retained by Flight-Industry LTD for the specific booking giving rise to the claim.

Section 8. Intellectual Property and Data Protection

All content, database rights, software, branding, and interfaces on the platform remain the exclusive intellectual property of Flight-Industry LTD or its licensors.

You agree not to copy, reverse-engineer, scrape, or commercially exploit any software, code, or data accessible through the platform.

Personal data is handled in accordance with our Privacy Policy and applicable data protection legislation, including the UK GDPR and EU General Data Protection Regulation.

Necessary passenger and guest details will be transmitted to our partners and suppliers solely for the purpose of completing your reservations.

Section 9. Governing Law and Jurisdiction

These Terms and Conditions, along with any non-contractual obligations or disputes arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England shall have exclusive jurisdiction over any legal proceedings, provided that consumers residing within the European Union retain the right to bring proceedings in the competent courts of their country of domicile pursuant to mandatory consumer protection laws.
