Terms and conditions of use and sale

1. General Provisions and Acceptance

These Terms and Conditions govern the use of the Flight-Industry website, mobile application and platform, as well as the booking services made available through the platform.

By accessing or using the platform, creating an account or making a booking, the customer acknowledges that they have read, understood and accepted these Terms and Conditions.

These Terms apply to flight and accommodation bookings made through Flight-Industry and to the use of the tourist activity search functionality described below.

Specific conditions applicable to a particular service or booking may also apply and form part of the contractual relationship with the customer.

2. Company Status and Role of Flight-Industry LTD

Flight-Industry LTD is a private limited company incorporated in the United Kingdom under company number 17311474, with its registered office at Office 19671, 182-184 High Street North, East Ham, London, United Kingdom, E6 2JA.

Flight-Industry operates a technology platform that enables users to search for and book certain travel services and to discover other travel-related services offered by third parties.

For flights and accommodation booked through Flight-Industry, Flight-Industry acts as an intermediary and booking platform between the customer and the relevant third-party service provider.

Flight-Industry is not an airline, hotel, accommodation provider, carrier, tour operator or direct provider of the underlying travel services.

At the current stage, Flight-Industry offers flight and accommodation bookings as separate booking services and does not intentionally offer travel packages.

Flight-Industry also provides a search and discovery service for tourist activities. However, Flight-Industry does not currently process or complete the booking of such activities directly on its own platform. Activity bookings are completed on the website or booking environment of Viator, or through the relevant third-party provider accessible through Viator.

The customer acknowledges that different terms, conditions, prices, cancellation rules and policies may apply to services provided or booked directly with third parties.

Nothing in these Terms is intended to exclude or restrict any mandatory consumer rights that cannot legally be excluded or restricted.

3. Booking Process and Confirmation

For flights and accommodation, the customer selects the service they wish to book and is provided with the available information concerning the service, applicable conditions and price before payment.

A reservation becomes valid and confirmed once the payment has been successfully accepted, processed and debited.

Following confirmation, the customer receives an email confirmation containing the relevant booking information and booking reference.

The booking information may also be available through the customer's account where this functionality is provided.

The customer is responsible for ensuring that all information supplied during the booking process is accurate and complete, including passenger names, dates of birth, contact details and other information required for the reservation.

For tourist activities, Flight-Industry may display information allowing the customer to search for and compare activities available through third-party providers.

When the customer chooses to proceed with an activity booking, the customer is redirected to Viator's website or booking environment, where the booking is completed directly with Viator or the relevant activity provider.

An activity booking is therefore not considered a booking made with Flight-Industry unless expressly stated otherwise.

4. Prices and Fees

All prices displayed on Flight-Industry for services available for booking through the platform are tax-inclusive prices (TTC) applicable to the selected service, as displayed during the booking process.

For flights and accommodation, applicable cancellation or modification fees, where relevant, are displayed during the booking process or in the customer's account.

For tourist activities, prices and booking conditions may be displayed on Flight-Industry for information and search purposes. The final price, applicable taxes, fees, cancellation conditions and other commercial conditions are determined by the relevant third-party provider and/or Viator at the time of booking on their website or booking environment.

The customer should therefore review the final price and applicable conditions displayed on Viator before completing an activity booking.

Additional charges imposed by suppliers, authorities or other third parties may apply where expressly identified in the applicable service conditions.

5. Payment

Payments for flights and accommodation booked through Flight-Industry are made using the payment methods made available on the platform, primarily bank or payment cards.

A flight or accommodation reservation is confirmed only after the payment has been successfully authorized, processed and debited.

Flight-Industry may use third-party payment service providers to process transactions.

If a payment is declined, cancelled, reversed or otherwise not completed, the relevant reservation may not be confirmed.

For tourist activities, payment is not made to Flight-Industry when the customer is redirected to Viator. The activity booking and payment are completed directly through Viator or the relevant third-party booking environment and are subject to their applicable payment terms.

6. Flight Reservations

Flight reservations are subject to the fare conditions, conditions of carriage and other rules of the relevant airline.

Flight-Industry acts as an intermediary for the booking and does not control the operation of the flight, schedules, aircraft, crew or operational decisions of the airline.

The customer must comply with all requirements imposed by the airline, including requirements concerning travel documents, check-in, baggage and boarding.

Where an airline modifies or cancels a flight and the situation is not attributable to the customer, the customer may, where this functionality is available, use their customer account to request cancellation or modification of the reservation, or accept the proposed modification.

Where a refund is due following the cancellation of a flight by the airline, Flight-Industry will process the refund within two (2) business days from confirmation that the refund is due and from the availability of the funds necessary to process the refund.

The refund will be made to the original payment method.

Any statutory passenger rights applicable to the customer remain unaffected.

7. Accommodation Reservations

Accommodation reservations are subject to the terms and conditions of the relevant accommodation provider, including its cancellation, modification, check-in, check-out and house rules.

The customer agrees to comply with the rules applicable to the accommodation booked.

If an accommodation provider cancels a confirmed reservation for a reason not attributable to the customer, the full amount paid for the reservation will be refunded to the original payment method within two (2) business days, subject to confirmation of the cancellation and availability of the funds necessary to process the refund.

8. Cancellation and Modification by the Customer

The customer may request the cancellation or modification of a flight or accommodation reservation where such cancellation or modification is permitted under the applicable booking conditions.

The applicable cancellation and modification deadlines are displayed during the booking process or in the customer's account.

Cancellation or modification penalties, supplier charges, administrative fees or fare differences may apply depending on the applicable booking conditions.

Where such charges apply, they will be displayed to the customer in accordance with the applicable booking conditions.

A request made after the applicable deadline may be refused or may result in additional charges.

For tourist activities booked through Viator, any cancellation or modification must be handled directly through Viator or the relevant activity provider, in accordance with the terms and conditions applicable to the activity booking.

Flight-Industry does not process cancellations, modifications or refunds for an activity booking completed directly through Viator.

9. Disruptions, Supplier Cancellations and Customer Protection

Where an event or incident affecting a flight or accommodation reservation occurs for a reason that is not attributable to the customer and causes a financial consequence directly related to the affected reservation, including a cancellation, Flight-Industry will process any refund to which the customer is entitled in accordance with the applicable booking conditions and applicable law.

Where a refund is due, it will be made to the original payment method.

The applicable refund rights and procedures may vary depending on the nature of the incident, the service provider, the booking conditions and applicable law.

For tourist activities booked through Viator, any cancellation, modification, disruption or refund is governed by the conditions applicable to the booking made through Viator and must generally be addressed directly with Viator or the relevant activity provider.

10. Travel Documents and Entry Requirements

The customer is solely responsible for ensuring that they hold all documents required for their travel and that such documents remain valid.

This may include a valid passport, visa, transit visa, electronic travel authorization, residence permit, health documents, vaccination certificates or any other document required by the competent authorities or relevant service provider.

Travel documents are generally not required to make a booking through Flight-Industry, except in certain exceptional circumstances where they are required by the service provider, the selected service, applicable regulations or the characteristics of the itinerary or destination.

The customer remains responsible for presenting the required documents at the airport and when boarding.

Flight-Industry cannot be held responsible for denied boarding, refusal of entry or any consequence resulting from missing, invalid or non-compliant travel documents, except where applicable law provides otherwise.

For tourist activities, the customer is responsible for complying with any identification, age, health, entry, safety or other requirements applicable to the activity and imposed by Viator or the activity provider.

11. Minors and Children

A minor may not independently book a flight through the Flight-Industry platform.

Any flight booking involving a minor must be made together with a booking involving a responsible adult.

The responsible adult is responsible for ensuring compliance with the conditions applicable to the minor's travel.

Airlines and accommodation providers may apply additional requirements concerning minimum age, minors travelling alone, accompanying adults or required documents.

Tourist activity providers may also impose specific age restrictions or requirements.

The customer is responsible for checking these requirements before completing a booking.

12. Customer Responsibilities

The customer agrees to provide accurate, complete and up-to-date information when using the platform and making a booking.

The customer must check the information contained in their booking confirmation and promptly report any error.

The customer must comply with the conditions applicable to the booked services and with the rules imposed by airlines, accommodation providers, activity providers, authorities and other relevant third parties.

The platform must not be used for fraudulent, unlawful or abusive purposes or in any manner that may infringe the rights of Flight-Industry, its partners or third parties.

When using the activity search functionality, the customer acknowledges that Flight-Industry provides search and discovery functionality and that the actual activity booking may be completed on a third-party website.

13. Complaints and Customer Support

The customer may submit any complaint or request for assistance to Flight-Industry using the contact form available on the platform or by email at flight-industry@flight-industry.com.

To facilitate the processing of a request, the customer should provide their booking reference, contact details and a clear description of the issue.

Where necessary, Flight-Industry may contact or liaise with the relevant service provider in order to assist the customer.

For urgent issues directly related to a flight or accommodation reservation, particularly on the day of travel or arrival, the customer may also be required to contact the airline or accommodation provider directly.

For tourist activities booked through Viator, complaints, booking issues, cancellations, modifications and refund requests should generally be addressed directly to Viator or the relevant activity provider, using the support channels made available by them.

Flight-Industry may assist the customer where reasonably possible in relation to the activity search or referral process, but does not control the contractual relationship between the customer and Viator or the activity provider.

14. Refunds

Where a refund is due under these Terms, the applicable booking conditions or applicable law, it will be made to the original payment method used by the customer.

Unless required by law or otherwise agreed, a refund will not be made to a different payment method or to a third party.

Flight-Industry will process refunds within the applicable timeframes where the conditions for the refund have been satisfied.

The time required for the funds to actually appear in the customer's account may depend on the customer's bank, card issuer or payment service provider.

For tourist activities booked through Viator, refunds are governed by the applicable Viator and activity provider terms and are processed through the relevant third-party booking and payment environment.

15. Force Majeure and Events Beyond Our Control

Flight-Industry cannot be held responsible for a delay, interruption or failure to perform resulting from an event reasonably beyond its control.

Such events may include natural disasters, severe weather, war, terrorism, civil unrest, government action, border closures, strikes, airport closures, telecommunications failures, payment system failures, cyber incidents, technical failures, supplier interruptions and failures of third-party systems or technology interfaces.

This provision applies subject to any mandatory rights and obligations imposed by applicable law.

16. Platform Availability and Technical Services

Flight-Industry seeks to maintain the availability and functionality of its platform but does not guarantee that the platform will always be accessible or operate without interruption or error.

The platform may depend on third-party systems, services, APIs, payment providers, travel technology providers, hosting infrastructure and other external services.

Temporary interruptions may occur due to maintenance, security measures, updates, technical failures or events beyond Flight-Industry's reasonable control.

Where a technical incident directly attributable to Flight-Industry affects a reservation and causes a financial loss directly related to that reservation, Flight-Industry will review the situation and, where applicable, process any refund due to the customer in accordance with these Terms and applicable law.

The activity search functionality may also depend on third-party information, availability feeds, APIs and other data sources. Flight-Industry does not guarantee the continuous availability, accuracy or completeness of information supplied by third-party activity providers or Viator.

17. Limitation of Liability

Flight-Industry primarily acts as an intermediary and provider of the booking and search platform.

The actual provision of flights, accommodation and other third-party services is the responsibility of the relevant service provider.

To the extent permitted by applicable law, Flight-Industry is not responsible for acts, omissions, delays, cancellations, modifications or failures of third-party providers where such matters do not result from a failure attributable to Flight-Industry.

In relation to tourist activities, Flight-Industry does not provide the activity itself and does not enter into the activity booking contract where the customer completes the booking directly with Viator or the relevant activity provider.

Accordingly, Flight-Industry is not responsible for the performance, cancellation, modification, quality, safety, availability or delivery of an activity booked directly through Viator, except where applicable law provides otherwise or where the relevant issue is directly attributable to Flight-Industry.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

Where Flight-Industry is legally responsible for an incident affecting a reservation or the use of its platform, the customer will have the remedies provided by these Terms and applicable law.

18. Intellectual Property

All intellectual property rights relating to the Flight-Industry platform, application, website, software, interface, design, structure, databases, texts, graphical content, trademarks, logos, visual elements and technologies used by Flight-Industry belong exclusively to Flight-Industry LTD or are used by Flight-Industry under an applicable licence.

Nothing in these Terms transfers any intellectual property rights to the customer.

Unless expressly authorized in writing by Flight-Industry or permitted by applicable law, the customer may not copy, reproduce, distribute, modify, adapt, decompile, disassemble, reverse engineer, scrape, extract data from, commercially exploit or otherwise use protected elements of the platform.

Information relating to third-party activities, including activity names, descriptions, images, prices and other content displayed through the activity search functionality, may belong to or be licensed by third parties and remains subject to their respective intellectual property rights.

19. Data Protection

The processing of the customer's personal data is governed by the Flight-Industry Privacy Policy.

Where necessary to provide flight or accommodation booking services, relevant personal data may be shared with airlines, accommodation providers, payment providers, technology providers, travel distribution partners and other service providers involved in fulfilling the reservation.

In relation to tourist activities, Flight-Industry may process information relating to the customer's use of the activity search functionality.

When the customer is redirected to Viator to complete an activity booking, the booking and payment process takes place outside the Flight-Industry platform.

Any personal data submitted directly to Viator or the relevant activity provider during that booking process is processed in accordance with their own privacy policies and terms.

20. Electronic Communications

The customer agrees that communications relating to bookings may be made electronically.

Such communications may include booking confirmations, payment confirmations, cancellation or modification notifications, operational information and customer service communications.

The customer must provide a valid email address and ensure that communications sent to that address can be received.

Electronic communications and associated records may be used as evidence of communications and transactions carried out through the platform, subject to applicable law.

Where the customer is redirected to a third-party website such as Viator, communications relating to the activity booking may subsequently be sent by Viator or the relevant activity provider in accordance with their own terms.

21. Applicable Law and Jurisdiction

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protection provisions that may apply to the customer in their country of residence.

Where permitted by applicable law, the courts of England and Wales shall have jurisdiction over disputes relating to these Terms or the services provided by Flight-Industry.

Nothing in this section deprives a consumer of mandatory rights granted by the laws applicable in their country of residence where such rights cannot legally be excluded by contract.

Any contractual relationship arising directly between the customer and Viator or an activity provider is subject to the applicable terms and governing law specified by that third party.

22. Changes to These Terms

Flight-Industry may amend these Terms from time to time to reflect changes to its services, platform, business practices or applicable legal and regulatory requirements.

The version of these Terms applicable to a booking will generally be the version in force at the time the booking is made.

Any subsequent changes will be communicated or implemented in accordance with applicable legal requirements.

23. Severability

If any provision of these Terms is declared invalid, unlawful or unenforceable by a competent authority, that provision shall, where possible, be interpreted or modified to the extent necessary to make it lawful and enforceable.

If such modification is not possible, the relevant provision shall be treated as severable from the remaining provisions.

The validity and enforceability of the remaining provisions shall not be affected.

24. Entire Agreement

These Terms, the booking information, the specific conditions applicable to the booked service, the booking confirmation and the applicable Flight-Industry policies constitute the contractual framework governing the relationship between the customer and Flight-Industry in relation to the use of the platform and the relevant booking.

For flights and accommodation, the specific conditions applicable to the relevant booking may supplement these Terms.

For tourist activities booked through Viator, the contractual relationship concerning the activity is established between the customer and the relevant third party in accordance with the terms displayed by Viator or the activity provider during the booking process.

In the event of any conflict, the specific terms applicable to the relevant third-party service may govern the contractual relationship between the customer and that third party.

Mandatory consumer rights remain unaffected.
